규정 소개

Introduction

 

 

 

SEC ESG 인증 운영규정은 SEC(Sustainable Enterprise Evaluation Commission)가 실시하는 기업·공공기관 ESG·WFSRI 평가의 평가결과를 바탕으로 인증을 부여하기 위한 기준과 절차를 규정하기 위하여 제정되었다.

 

The SEC ESG Certification Regulations have been established to prescribe the standards and procedures for granting certification based on evaluation results arising from the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions.

 

SEC ESG 인증은 지속가능경영, 책임경영, 사회적 가치 창출 및 미래 대응 역량이 우수한 평가대상을 인증함으로써 지속가능한 성장과 책임 있는 경영문화 확산에 기여하는 것을 목적으로 한다.

 

SEC ESG Certification aims to recognize Evaluated Organizations demonstrating excellence in sustainability, Responsible Management, social value creation, and future readiness, thereby contributing to sustainable growth and the promotion of responsible management practices.

 

SEC ESG 인증은 SEC WFSRI Rating과 연계하여 운영하되, SEC WFSRI Rating과는 별도의 인증제도로 운영하며, 평가결과의 사회적 활용성과 신뢰성을 제고하기 위한 제도적 장치로 기능한다.

 

SEC ESG Certification operates in conjunction with SEC WFSRI Ratings while remaining a separate certification system and serves as an institutional mechanism to enhance the social utility and credibility of evaluation results.

 

 

 

제1장 총칙

Chapter 1. General Provisions

 

 

제1조(목적)

Article 1 (Purpose)

 

본 규정은 SEC ESG 인증의 운영에 필요한 사항을 정함으로써 지속가능경영과 책임경영을 실천하는 평가대상을 인증하고 ESG 경영문화 확산에 기여하는 것을 목적으로 한다.

 

These Regulations prescribe matters necessary for the operation of SEC ESG Certification in order to recognize Evaluated Organizations demonstrating sustainability and Responsible Management and to contribute to the promotion of ESG management practices.

 

 

제2조(적용범위)

Article 2 (Scope of Application)

 

본 규정은 SEC가 실시하는 기업·공공기관 ESG·WFSRI 평가와 연계하여 운영하는 SEC ESG 인증에 적용한다.

 

These Regulations apply to SEC ESG Certification operated in conjunction with the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions.

 

 

제3조(정의)

Article 3 (Definitions)

 

본 규정에서 사용하는 용어의 뜻은 다음과 같다.

 

The terms used in these Regulations shall have the following meanings:

 

① “SEC ESG 인증(SEC ESG Certification)”이란 SEC가 기업·공공기관 ESG·WFSRI 평가결과와 인증심의 결과를 바탕으로 인증기준을 충족한 평가대상에 부여하는 인증을 말한다.

 

“SEC ESG Certification” means certification granted by SEC to an Evaluated Organization that satisfies the certification criteria, based on the results of the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions and the outcome of the certification review.

 

② “인증대상(Certified Entity)”이란 인증심사를 거쳐 SEC ESG 인증을 부여받은 평가대상을 말한다.

 

“Certified Entity” means an Evaluated Organization that has been granted SEC ESG Certification through the certification review process.

 

 

제2장 인증제도

Chapter 2. Certification Program

 

 

제4조(인증의 기본원칙)

Article 4 (Fundamental Principles of Certification)

 

① 인증은 객관성, 공정성, 독립성 및 투명성을 원칙으로 운영한다.

 

Certification shall be administered based on the principles of Objectivity, Fairness, Independence, and Transparency.

 

② 인증은 SEC가 실시하는 기업·공공기관 ESG·WFSRI 평가의 평가결과를 바탕으로 운영한다.

 

Certification shall be based on evaluation results arising from the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions.

 

 

제5조(인증기준)

Article 5 (Certification Criteria)

 

① SEC ESG 인증은 SEC WFSRI Rating, 평가결과 및 인증심의 결과를 종합적으로 고려하여 부여할 수 있다.

 

SEC ESG Certification may be granted based on comprehensive consideration of the SEC WFSRI Rating, evaluation results, and the outcome of the certification review.

 

② SEC ESG 인증의 세부적인 부여기준은 SEC가 별도로 정한다.

 

Detailed criteria for granting SEC ESG Certification shall be determined separately by SEC.

 

③ SEC WFSRI Rating의 부여만으로 SEC ESG 인증이 자동으로 부여되는 것은 아니다.

 

The assignment of an SEC WFSRI Rating shall not, by itself, constitute the granting of SEC ESG Certification.

 

 

제3장 인증심의위원회

Chapter 3. Certification Review Committee

 

 

제6조(인증심의위원회의 설치)

Article 6 (Establishment of the Certification Review Committee)

 

SEC는 인증의 공정성과 객관성을 확보하기 위하여 인증심의위원회를 둘 수 있다.

 

SEC may establish a Certification Review Committee to ensure fairness and objectivity in certification decisions.

 

 

제7조(위원회의 구성)

Article 7 (Composition of the Committee)

 

① 인증심의위원회는 위원장 1인을 포함한 5인 이상 9인 이하의 위원으로 구성할 수 있다.

 

The Certification Review Committee may consist of not fewer than five (5) and not more than nine (9) members, including a Chairperson.

 

② 위원의 과반수는 SEC 외부 전문가로 구성하는 것을 원칙으로 한다.

 

A majority of the Committee members shall, in principle, be external experts independent of SEC.

 

③ 위원은 ESG, 지속가능경영, 법률, 회계, 경영, 공공정책 또는 관련 분야의 전문지식과 경험을 갖춘 자 중에서 위촉할 수 있다.

 

Members may be appointed from among individuals possessing expertise and experience in ESG, sustainability, law, accounting, management, public policy, or related fields.

 

 

제8조(위원의 제척·기피·회피)

Article 8 (Disqualification, Challenge, and Recusal of Members)

 

인증심의위원의 제척, 기피 및 회피에 관한 사항은 SEC 관련 규정에 따른다.

 

Matters concerning the disqualification, challenge, and recusal of Certification Review Committee members shall be governed by relevant SEC regulations.

 

제4장 인증 부여

Chapter 4. Granting of Certification

 

 

제9조(인증 부여)

Article 9 (Granting of Certification)

 

① SEC는 인증기준을 충족한 평가대상에 SEC ESG 인증을 부여할 수 있다.

 

SEC may grant SEC ESG Certification to an Evaluated Organization that satisfies the certification criteria.

 

② 인증 부여 여부는 기업·공공기관 ESG·WFSRI 평가의 평가결과와 인증심의 결과를 종합적으로 고려하여 결정한다.

 

Whether to grant certification shall be determined based on comprehensive consideration of the results of the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions and the outcome of the certification review.

 

 

제10조(인증서 발급)

Article 10 (Issuance of Certificates)

 

SEC는 SEC ESG 인증을 받은 인증대상에 인증서를 발급할 수 있다.

 

SEC may issue certificates to Certified Entities.

 

 

제11조(인증의 유효기간)

Article 11 (Validity Period of Certification)

 

① 인증의 유효기간은 인증 부여일로부터 1년을 원칙으로 한다.

 

The validity period of certification shall, in principle, be one (1) year from the date of certification.

 

② 인증의 갱신에 관한 사항은 SEC가 별도로 정한다.

 

Matters concerning certification renewal shall be determined separately by SEC.

 

제5장 인증의 활용

Chapter 5. Utilization of Certification

 

 

제12조(인증의 표시)

Article 12 (Use of Certification Marks)

 

SEC ESG 인증을 받은 인증대상은 SEC가 정하는 기준에 따라 인증서, 인증마크 및 인증 사실을 표시하거나 홍보할 수 있다.

 

Certified Entities may display or publicize their certificates, certification marks, and certification status in accordance with standards established by SEC.

 

 

제13조(인증의 활용)

Article 13 (Utilization of Certification)

 

SEC는 인증결과를 ESG 우수사례 발굴, 지속가능경영 및 책임경영 확산, 연구 및 정책개발 등의 목적으로 활용할 수 있다.

 

SEC may utilize certification results for identifying ESG best practices, promoting sustainability and Responsible Management, conducting research, and supporting policy development.

 

 

제6장 인증의 정지 및 취소

Chapter 6. Suspension and Revocation of Certification

 

 

제14조(인증의 정지)

Article 14 (Suspension of Certification)

 

SEC는 인증기준 위반, 인증의 적정성에 영향을 미치는 중대한 사유의 발생 또는 그 밖의 정당한 사유가 있는 경우 인증의 효력을 정지할 수 있다.

 

SEC may suspend certification where certification criteria have been violated, where material circumstances affecting the appropriateness of the certification have arisen, or where other legitimate grounds exist.

 

 

제15조(인증의 취소)

Article 15 (Revocation of Certification)

 

SEC는 다음 각 호의 어느 하나에 해당하는 경우 인증을 취소할 수 있다.

 

SEC may revoke certification in any of the following circumstances:

 

 

① 허위 또는 부정한 방법으로 인증을 받은 경우

Where certification was obtained through false or improper means.

 

② 인증기준을 중대하게 위반한 경우

Where certification criteria have been materially violated.

 

③ 인증의 근거가 된 평가자료 또는 주요 사실관계에 중대한 허위 또는 오류가 확인된 경우

Where material falsity or error is identified in evaluation materials or material factual information on which the certification was based.

 

④ 인증의 신뢰성과 공정성을 현저히 훼손하는 중대한 사유가 확인된 경우

Where material circumstances are identified that significantly undermine the credibility and fairness of the certification.

 

⑤ 그 밖에 인증을 유지하기 어렵다고 인정할 만한 객관적이고 중대한 사유가 있는 경우

Where other objective and material grounds exist that make continued certification inappropriate.

 

 

제16조(의견제출)

Article 16 (Opportunity to Submit Comments)

 

① SEC는 인증을 정지하거나 취소하려는 경우 해당 인증대상에 그 사유를 통보하고 의견 및 관련 자료를 제출할 기회를 부여하여야 한다.

 

Where SEC intends to suspend or revoke certification, it shall notify the Certified Entity of the grounds and provide an opportunity to submit comments and relevant supporting materials.

 

② SEC는 제출된 의견과 자료를 검토한 후 인증의 정지 또는 취소 여부를 결정한다.

 

SEC shall review the submitted comments and materials before determining whether to suspend or revoke the certification.

 

 

 

제7장 보칙

Chapter 7. Supplementary Provisions

 

 

제17조(SEC WFSRI Rating 운영규정과의 관계)

Article 17 (Relationship with the SEC WFSRI Rating Regulations)

 

본 규정은 「SEC WFSRI Rating 운영규정」과 연계하여 적용한다.

 

These Regulations shall be applied in conjunction with the SEC WFSRI Rating Regulations.

 

 

제18조(세부사항)

Article 18 (Detailed Matters)

 

본 규정의 시행에 필요한 세부사항은 SEC가 별도로 정하는 기준에 따른다.

 

Detailed matters necessary for the implementation of these Regulations shall be governed by standards separately established by SEC.

 

 

제19조(평가 거버넌스 체계)

Article 19 (Evaluation Governance Framework)

 

본 규정은 SEC 평가 거버넌스 체계(SEC Evaluation Governance Framework)의 구성 규정으로 운영한다.

 

These Regulations shall operate as a constituent regulation of the SEC Evaluation Governance Framework.

 

 

 

부칙

Supplementary Provisions

 

 

제1조(시행일)

Article 1 (Effective Date)

 

본 규정은 2026년 1월 1일부터 시행한다.

 

These Regulations shall take effect on January 1, 2026.

 

 

제2조(적용)

Article 2 (Application)

 

본 규정은 SEC가 실시하는 기업·공공기관 ESG·WFSRI 평가와 연계한 SEC ESG 인증에 적용한다.

 

These Regulations shall apply to SEC ESG Certification in conjunction with the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions.
