    Management of Relationships with Evaluation Subjects

     

     

     

    평가기관은 평가업무를 수행하는 과정에서 평가대상기관과 다양한 형태의 관계를 형성할 수 있다. 이러한 관계의 존재 자체가 평가의 독립성이나 공정성을 훼손하는 것은 아니지만, 경제적·사업적 또는 기타 이해관계가 개별 평가에 관한 전문적 판단에 영향을 미치게 되면 평가결과에 대한 신뢰가 훼손될 수 있다.

     

    An evaluation institution may form various types of relationships with evaluation subjects in the course of its activities. The existence of such relationships does not, in itself, compromise the Independence or Fairness of Evaluation. However, confidence in evaluation results may be undermined if economic, business, or other interests influence professional judgments concerning individual evaluations.

     

    SEC(Sustainable Enterprise Evaluation Commission)는 평가대상기관과의 관계와 개별 평가에 관한 전문적 판단을 구분하고, 해당 관계가 평가결과·평가등급 또는 인증결정에 부당한 영향을 미치지 않도록 이해관계를 관리한다.

     

    SEC (Sustainable Enterprise Evaluation Commission) distinguishes relationships with evaluation subjects from professional judgments concerning individual evaluations and manages relevant interests to ensure that such relationships do not improperly influence evaluation results, Ratings, or Certification decisions.

     

    Ⅰ. 평가대상기관과의 관계에 관한 기본원칙

    I. Fundamental Principles Governing Relationships with Evaluation Subjects

     

     

    SEC는 평가대상기관과 경제적·사업적 또는 기타 관계가 존재한다는 사실만으로 해당 기관과의 이해상충 여부를 일률적으로 판단하지 않는다.

     

    SEC does not determine the existence of a conflict of interest solely on the basis that an economic, business, or other relationship exists with an evaluation subject.

     

    평가대상기관과의 관계가 확인된 경우에는 해당 관계의 성격과 정도, 평가업무와의 관련성 및 개별 평가에 관한 전문적 판단에 미칠 수 있는 영향을 종합적으로 검토한다.

     

    Where a relationship with an evaluation subject is identified, SEC comprehensively reviews the nature and extent of the relationship, its relevance to evaluation activities, and its potential impact on professional judgments concerning the individual evaluation.

     

    평가대상기관과의 관계는 그 자체로 해당 기관에 유리하거나 불리한 평가를 하는 근거가 될 수 없다.

     

    A relationship with an evaluation subject must not, in itself, serve as a basis for favorable or unfavorable treatment of that institution.

     

     

    Ⅱ. 경제적·사업적 관계와 평가의 분리

    II. Separation of Economic and Business Relationships from Evaluation

     

     

    SEC는 평가대상기관과의 경제적·사업적 관계가 개별 평가결과·평가등급 또는 인증결정에 부당한 영향을 미치지 않도록 관리한다.

     

    SEC manages economic and business relationships with evaluation subjects to ensure that such relationships do not improperly influence individual evaluation results, Ratings, or Certification decisions.

     

    계약, 연구, 교육, 협력 또는 기타 사업관계가 존재하는 경우에도 개별 평가에 관한 전문적 판단은 해당 관계와 구분하여 이루어진다.

     

    Even where contractual, research, educational, cooperative, or other business relationships exist, professional judgments concerning individual evaluations are made separately from such relationships.

     

    전문적 평가판단은 객관적인 자료와 검증 가능한 정보, SEC 평가방법론(SEC Evaluation Methodology), SEC 평가체계(SEC Evaluation Framework) 및 정해진 평가절차에 따라 이루어진다.

     

    Professional evaluation judgments are made on the basis of objective data, verifiable information, the SEC Evaluation Methodology, the SEC Evaluation Framework, and established evaluation procedures.

     

    Ⅲ. 재정적 기여와 평가결과의 분리

    III. Separation of Financial Contributions from Evaluation Results

     

     

    평가대상기관의 재정적 기여 여부는 그 자체로 개별 평가결과·평가등급 또는 인증결정을 유리하거나 불리하게 하는 근거가 될 수 없다.

     

    Whether an evaluation subject has made a financial contribution must not, in itself, serve as a basis for favorable or unfavorable treatment in individual evaluation results, Ratings, or Certification decisions.

     

    재정적 기여가 있다는 이유로 특정 평가대상기관에 유리한 평가를 하거나, 재정적 기여가 없다는 이유로 불리한 평가를 해서는 안 된다.

     

    An evaluation subject must not receive favorable treatment because it has made a financial contribution, nor unfavorable treatment because it has not.

     

    SEC는 평가결과·평가등급 또는 인증결정의 유리한 변경을 조건으로 금전적 또는 기타 경제적 이익을 요구하거나 제공받지 않는다.

     

    SEC does not request or accept monetary or other economic benefits in exchange for favorable changes to evaluation results, Ratings, or Certification decisions.

     

     

    Ⅳ. 평가대상기관과의 정당한 소통

    IV. Legitimate Communication with Evaluation Subjects

     

     

    평가의 독립성은 평가대상기관과의 모든 소통을 제한하는 것을 의미하지 않는다. 평가를 정확하고 객관적으로 수행하기 위해서는 평가자료의 제출, 자료의 확인과 보완, 사실관계 확인 등 필요한 소통이 이루어질 수 있다.

     

    The Independence of Evaluation does not mean restricting all communication with evaluation subjects. Communication necessary for accurate and objective evaluation may take place, including the submission of evaluation materials, verification and supplementation of materials, and confirmation of relevant facts.

     

    평가대상기관은 정해진 절차에 따라 평가에 필요한 자료와 의견을 제출하고 사실확인 및 이의신청 절차를 이용할 수 있다.

     

    Evaluation subjects may submit materials and views necessary for evaluation and use Factual Review and Appeal procedures in accordance with established procedures.

     

    이러한 정당한 소통과 절차의 이용은 그 자체로 평가에 대한 부당한 개입이나 이해상충으로 보지 않는다.

     

    Such legitimate communication and use of established procedures are not, in themselves, regarded as improper interference in evaluation or as a conflict of interest.

     

     

     

    Ⅴ. 평가대상기관의 부당한 영향력 차단

    V. Prevention of Undue Influence by Evaluation Subjects

     

     

    평가대상기관은 정당한 평가절차를 벗어나 특정한 평가판단·평가결과·평가등급 또는 인증결정을 요구하거나 이에 영향을 미치기 위한 부당한 압력이나 청탁을 해서는 안 된다.

     

    Evaluation subjects must not, outside legitimate evaluation procedures, demand a particular evaluation judgment, evaluation result, Rating, or Certification decision or exert improper pressure or solicitation intended to influence such decisions.

     

    경제적·사업적 관계 또는 기타 이해관계를 이용하여 평가위원장, 평가위원 또는 평가업무 수행자의 전문적 판단에 부당한 영향을 미쳐서는 안 된다.

     

    Economic or business relationships or other interests must not be used to improperly influence the professional judgment of the Chair of the Evaluation Committee, Evaluation Committee members, or persons engaged in evaluation activities.

     

    정당한 절차를 통한 자료제출이나 사실관계에 관한 의견제시와 특정 평가결과를 얻기 위한 부당한 영향력 행사는 명확하게 구분한다.

     

    The submission of materials or presentation of views concerning factual matters through legitimate procedures is clearly distinguished from the exercise of undue influence intended to obtain a particular evaluation result.

     

     

     

    Ⅵ. 이해상충이 확인된 경우의 관리

    VI. Management Where a Conflict of Interest Is Identified

     

     

    평가대상기관과의 관계로 인해 이해상충이 발생하거나 발생할 가능성이 확인된 경우 SEC는 해당 관계의 성격과 정도 및 평가업무에 미칠 수 있는 영향을 검토한다.

     

    Where an actual or potential conflict of interest arising from a relationship with an evaluation subject is identified, SEC reviews the nature and extent of the relationship and its potential impact on evaluation activities.

     

    필요한 경우 업무분리, 정보차단, 접근권한 제한, 업무 재배정, 제척·회피 등 평가의 독립성과 공정성을 보호하기 위한 적절한 관리조치를 적용한다.

     

    Where necessary, SEC applies appropriate management measures to protect the Independence and Fairness of Evaluation, including separation of duties, information barriers, restrictions on access, reassignment of responsibilities, recusal, and avoidance.

     

    적절한 관리조치를 통해 평가의 독립성과 공정성을 확보할 수 있는 경우에는 정해진 평가원칙과 절차에 따라 평가를 계속 수행한다.

     

    Where the Independence and Fairness of Evaluation can be safeguarded through appropriate management measures, the evaluation continues in accordance with established evaluation principles and procedures.

     

    Ⅶ. 관계의 유무에 따른 차별 금지

    VII. No Favorable or Unfavorable Treatment Based on Relationships

     

     

    SEC와 경제적·사업적 또는 기타 관계가 있다는 이유만으로 평가대상기관에 유리한 평가를 해서는 안 되며, 그러한 관계가 없다는 이유만으로 불리한 평가를 해서도 안 된다.

     

    An evaluation subject must not receive favorable treatment merely because it has an economic, business, or other relationship with SEC, nor unfavorable treatment merely because no such relationship exists.

     

    평가대상기관이 SEC의 다른 사업이나 활동에 참여하는지 여부 역시 그 자체로 개별 평가결과·평가등급 또는 인증결정을 결정하는 요소가 될 수 없다.

     

    Whether an evaluation subject participates in other SEC activities or business operations must not, in itself, determine individual evaluation results, Ratings, or Certification decisions.

     

    모든 개별 평가에 관한 전문적 판단은 평가대상기관과 SEC 사이의 관계와 구분하여 정해진 평가기준과 절차에 따라 이루어진다.

     

    Professional judgments concerning all individual evaluations are made separately from relationships between the evaluation subject and SEC and in accordance with established evaluation criteria and procedures.

     

     

    Ⅷ. 지속적인 이해관계 관리

    VIII. Ongoing Management of Relationships and Conflicts of Interest

     

     

    평가대상기관과의 이해관계 관리는 평가를 시작하는 시점에 한정되지 않고 평가가 진행되는 전 과정에서 지속적으로 이루어진다.

     

    Management of relationships and conflicts of interest involving evaluation subjects is not limited to the beginning of an evaluation but continues throughout the evaluation process.

     

    평가과정에서 새로운 경제적·사업적 관계 또는 기타 이해관계가 발생하거나 기존 관계의 성격이 변경된 경우에는 해당 사항이 평가의 독립성과 공정성에 미칠 수 있는 영향을 확인하고 필요한 관리조치를 적용한다.

     

    Where a new economic, business, or other relationship arises during the evaluation process, or the nature of an existing relationship changes, SEC assesses its potential impact on the Independence and Fairness of Evaluation and applies necessary management measures.

     

    이를 통해 SEC는 평가대상기관과의 관계가 개별 평가에 관한 전문적 판단을 좌우하지 않도록 하고, 평가결과가 객관적인 자료와 검증 가능한 정보 및 정해진 평가원칙과 절차에 따라 독립적이고 공정하게 도출되도록 한다.

     

    Through these measures, SEC ensures that relationships with evaluation subjects do not determine professional judgments concerning individual evaluations and that evaluation results are derived independently and fairly on the basis of objective data, verifiable information, and established evaluation principles and procedures.
