제1장 총칙
Chapter 1. General Provisions

 

제1조(목적)

Article 1 (Purpose)

 

본 규정은 SEC(Sustainable Enterprise Evaluation Commission)의 평가 및 인증 관련 업무에 참여하는 평가위원, 인증심의위원 및 관련 업무 담당자의 윤리기준을 정함으로써 평가와 인증의 독립성, 객관성, 공정성 및 투명성을 확보하고 공익에 기여함을 목적으로 한다.

 

These Regulations establish ethical standards for Evaluation Committee Members, Certification Review Committee Members, and personnel participating in SEC evaluation and certification activities in order to ensure the independence, objectivity, fairness, and transparency of evaluations and certifications and to contribute to the public interest.

 

 

제2조(적용범위)

Article 2 (Scope of Application)

 

본 규정은 다음 각 호의 자에게 적용한다.

These Regulations shall apply to the following persons:

 

① 평가위원

Evaluation Committee Members

 

② 인증심의위원

Certification Review Committee Members

 

③ 평가 관련 업무 담당자

Personnel Engaged in Evaluation Activities

 

④ 인증 관련 업무 담당자

Personnel Engaged in Certification Activities

 

⑤ 그 밖에 SEC의 평가 또는 인증 관련 업무에 참여하는 자

Other Persons Participating in SEC Evaluation or Certification Activities

 

 

제3조(기본윤리원칙)

Article 3 (Fundamental Ethical Principles)

 

평가 및 인증 관련자는 다음 각 호의 원칙을 준수하여야 한다.

 

Personnel involved in evaluation and certification activities shall comply with the following principles:

 

① 독립성 (Independence)

② 객관성 (Objectivity)

③ 공정성 (Fairness)

④ 청렴성 (Integrity)

⑤ 책임성 (Accountability)

⑥ 비밀유지 (Confidentiality)

⑦ 공익성 (Public Interest)

 

 

제4조(윤리적 책무)

Article 4 (Ethical Responsibility)

 

평가 및 인증 관련자는 SEC의 책임경영 평가철학과 평가원칙을 존중하고, 평가와 인증의 신뢰성 및 사회적 책임을 높이기 위하여 노력하여야 한다.

 

Personnel involved in evaluation and certification activities shall respect SEC’s Responsible Management evaluation philosophy and evaluation principles and shall strive to enhance the credibility and social responsibility of evaluations and certifications.

 

제2장 독립성 및 공정성

Chapter 2. Independence and Fairness

 

 

제5조(독립성 유지)

Article 5 (Maintenance of Independence)

 

평가 및 인증 관련자는 외부의 부당한 영향 없이 독립적으로 직무를 수행하여야 한다.

 

Personnel involved in evaluation and certification activities shall perform their duties independently and free from improper external influence.

 

 

제6조(객관적 판단)

Article 6 (Objective Judgment)

 

평가 및 인증 관련자는 사실과 객관적인 근거자료에 기초하여 판단하여야 한다.

 

Personnel involved in evaluation and certification activities shall make judgments based on facts and objective supporting evidence.

 

 

제7조(공정한 평가 및 인증)

Article 7 (Fair Evaluation and Certification)

 

평가 및 인증 관련자는 특정 평가대상에 유리하거나 불리하게 평가하거나 인증하여서는 아니 된다.

 

Personnel involved in evaluation and certification activities shall not favor or disadvantage any particular Evaluated Organization in evaluation or certification activities.

 

 

제8조(평가위원회 및 인증심의위원회의 독립성)

Article 8 (Independence of the Evaluation Committee and Certification Review Committee)

 

평가위원회 및 인증심의위원회는 외부의 압력, 로비 또는 이해관계자의 영향력으로부터 독립적으로 운영되어야 한다.

 

The Evaluation Committee and Certification Review Committee shall operate independently from external pressure, lobbying, or influence by interested parties.

 

 

제3장 청렴 및 경제적 독립성

Chapter 3. Integrity and Financial Independence

 

 

제9조(청렴의무)

Article 9 (Integrity Obligation)

 

평가 및 인증 관련자는 직무수행 과정에서 높은 수준의 청렴성을 유지하여야 한다.

 

Personnel involved in evaluation and certification activities shall maintain a high standard of integrity in the performance of their duties.

 

 

제10조(경제적 독립성)

Article 10 (Financial Independence)

 

평가 및 인증 관련자는 평가 및 인증 관련 직무를 수행함에 있어 경제적 이해관계로부터 독립성을 유지하여야 한다.

 

Personnel involved in evaluation and certification activities shall maintain independence from financial interests in the performance of their duties.

 

 

제11조(금품수수 금지)

Article 11 (Prohibition of Acceptance of Benefits)

 

평가 및 인증 관련자는 평가대상으로부터 금품, 향응, 편의 또는 그 밖의 경제적 이익을 제공받거나 요구하여서는 아니 된다.

 

Personnel involved in evaluation and certification activities shall neither accept nor solicit money, gifts, hospitality, favors, or other economic benefits from Evaluated Organizations.

 

 

제12조(재정적 기여와 평가의 독립성)

Article 12 (Financial Contributions and Evaluation Independence)

 

① 평가대상의 재정적 기여 여부는 평가결과, SEC WFSRI Rating 또는 SEC ESG 인증에 어떠한 영향도 미쳐서는 아니 된다.

 

Whether an Evaluated Organization makes any financial contribution shall not influence evaluation results, SEC WFSRI Ratings, or SEC ESG Certification in any manner.

 

② SEC 및 평가·인증 관련자는 평가의 독립성과 공정성을 확보하기 위하여 평가대상으로부터 평가비, 심사비, 인증비 또는 평가·인증의 대가로 제공되는 그 밖의 경제적 이익을 받지 아니한다.

 

SEC and personnel involved in evaluation and certification activities shall not accept evaluation fees, review fees, certification fees, or other economic benefits provided in consideration for evaluation or certification from Evaluated Organizations, in order to ensure the independence and fairness of evaluations.

 

③ 평가대상으로부터 제공되는 후원금 또는 그 밖의 재정적 지원은 평가 및 인증 업무와 명확히 분리되어야 하며, 평가결과, SEC WFSRI Rating, SEC ESG 인증 또는 평가·인증 관련 의사결정에 어떠한 영향도 미쳐서는 아니 된다.

 

Any sponsorship or other financial support provided by an Evaluated Organization shall be clearly separated from evaluation and certification activities and shall not influence evaluation results, SEC WFSRI Ratings, SEC ESG Certification, or any evaluation- or certification-related decision in any manner.

 

 

 

제4장 비밀유지

Chapter 4. Confidentiality

 

 

제13조(비공개 정보 보호)

Article 13 (Protection of Non-Public Information)

 

평가 및 인증 관련자는 직무상 취득한 비공개 정보를 보호하여야 한다.

 

Personnel involved in evaluation and certification activities shall protect non-public information acquired through their duties.

 

 

제14조(정보의 부당이용 금지)

Article 14 (Prohibition of Improper Use of Information)

 

평가 및 인증 관련자는 직무상 취득한 비공개 정보를 사적 이익을 위하여 이용하여서는 아니 된다.

 

Personnel involved in evaluation and certification activities shall not use non-public information acquired through their duties for personal benefit.

 

 

제15조(평가위원 신원 비공개 원칙)

Article 15 (Non-Disclosure of Evaluation Committee Members’ Identities)

 

SEC는 평가위원에 대한 외부 압력, 로비 및 이해관계자의 영향력 행사를 방지하고 평가의 독립성과 공정성을 보호하기 위하여 개별 평가위원의 신원을 공개하지 아니한다.

 

SEC shall not disclose the identities of individual Evaluation Committee Members in order to prevent external pressure, lobbying, or influence by interested parties and to protect the independence and fairness of evaluations.

 

다만, 평가위원장은 공개할 수 있다.

 

However, the Chairperson of the Evaluation Committee may be publicly disclosed.

 

 

제16조(퇴임 후 의무)

Article 16 (Post-Service Obligations)

 

평가 및 인증 관련자의 비밀유지 의무는 해당 직무가 종료된 이후에도 지속된다.

 

The confidentiality obligations of personnel involved in evaluation and certification activities shall continue after the termination of their duties.

 

 

 

제5장 윤리교육 및 관리

Chapter 5. Ethics Education and Administration

 

 

제17조(윤리교육)

Article 17 (Ethics Education)

 

SEC는 평가 및 인증 관련자의 윤리의식을 높이고 평가윤리를 확립하기 위하여 필요한 교육을 실시할 수 있다.

 

SEC may provide education necessary to enhance ethical awareness among personnel involved in evaluation and certification activities and to promote evaluation ethics.

 

 

제18조(윤리서약)

Article 18 (Ethical Commitment)

 

평가위원, 인증심의위원 및 평가·인증 관련 업무에 참여하는 자는 SEC가 정하는 바에 따라 윤리서약을 제출하여야 한다.

 

Evaluation Committee Members, Certification Review Committee Members, and persons participating in evaluation or certification activities shall submit an ethical commitment in accordance with standards established by SEC.

 

 

제19조(윤리관리)

Article 19 (Ethics Administration)

 

SEC는 본 규정에 따른 윤리기준의 준수 여부를 지속적으로 점검·관리하여야 한다.

 

SEC shall continuously monitor and manage compliance with the ethical standards established under these Regulations.

 

제6장 윤리위반 조사 및 조치

Chapter 6. Investigation and Measures for Ethical Violations

 

 

제20조(위반신고)

Article 20 (Reporting Violations)

 

누구든지 본 규정에 따른 윤리기준의 위반 사실을 SEC에 신고할 수 있다.

 

Any person may report to SEC an alleged violation of the ethical standards established under these Regulations.

 

 

제21조(조사)

Article 21 (Investigation)

 

SEC는 윤리위반 신고가 있거나 윤리위반의 가능성을 인지한 경우 필요한 사실관계를 확인하고 윤리위반 여부를 조사할 수 있다.

 

SEC may verify relevant facts and investigate an alleged ethical violation where a report has been received or where SEC becomes aware of a possible ethical violation.

 

 

제22조(소명기회 부여)

Article 22 (Opportunity to Respond)

 

SEC는 윤리위반에 따른 조치를 결정하기 전에 조사대상자에게 의견을 제출하거나 소명할 기회를 부여하여야 한다.

 

Before determining measures in response to an ethical violation, SEC shall provide the subject of the investigation with an opportunity to submit comments or explanations.

 

 

제23조(조치)

Article 23 (Measures)

 

SEC는 윤리위반의 내용, 정도 및 관련 사정을 고려하여 윤리위반자에 대하여 다음 각 호의 조치를 취할 수 있다.

 

SEC may take any of the following measures against a person who has committed an ethical violation, taking into consideration the nature and severity of the violation and relevant circumstances:

 

 

① 경고

Warning

 

② 직무배제

Removal from Duties

 

③ 해촉

Dismissal from Committee Membership

 

④ 자격제한

Restriction of Qualifications

 

⑤ 그 밖에 윤리위반의 정도와 성격에 따라 필요하다고 인정되는 조치

Other measures deemed necessary in consideration of the nature and severity of the ethical violation

 

 

제7장 다른 규정과의 관계

Chapter 7. Relationship with Other Regulations

 

 

제24조(SEC 이해상충 방지규정과의 관계)

Article 24 (Relationship with the SEC Conflict of Interest Regulations)

 

이해상충에 관한 사항은 「SEC 이해상충 방지규정」에 따른다.

 

Matters concerning conflicts of interest shall be governed by the SEC Conflict of Interest Regulations.

 

 

제25조(SEC WFSRI Rating 운영규정과의 관계)

Article 25 (Relationship with the SEC WFSRI Rating Regulations)

 

본 규정은 「SEC WFSRI Rating 운영규정」과 연계하여 적용한다.

 

These Regulations shall be applied in conjunction with the SEC WFSRI Rating Regulations.

 

 

제26조(평가 거버넌스 체계)

Article 26 (Evaluation Governance Framework)

 

본 규정은 SEC 평가 거버넌스 체계(SEC Evaluation Governance Framework)의 구성 규정으로 운영한다.

 

These Regulations shall operate as a constituent regulation of the SEC Evaluation Governance Framework.

 

 

 

부칙

Supplementary Provisions

 

 

제1조(시행일)

Article 1 (Effective Date)

 

본 규정은 2026년 1월 1일부터 시행한다.

These Regulations shall take effect on January 1, 2026.

 

 

제2조(적용)

Article 2 (Application)

 

본 규정은 SEC가 실시하는 기업·공공기관 ESG·WFSRI 평가 및 이와 연계한 SEC ESG 인증 관련 업무에 적용한다.

 

These Regulations shall apply to activities related to the SEC ESG·WFSRI Evaluation for Corporations and Public Institutions and the associated SEC ESG Certification.

 

 

제3조(규정의 개정)

Article 3 (Amendment)

 

본 규정의 개정은 평가위원회의 심의·의결을 거쳐 시행한다.

 

Any amendment to these Regulations shall be adopted through deliberation and resolution by the Evaluation Committee.
